Important legal information

This system is for legitimate users only - all unauthorised access is prohibited.

1. Definitions

1.1 “Modules” means the four MoneySense modules that form part of MoneySense and which consist of various financial information and activities. These Modules are available in two formats – as online activities on the MoneySense website and as photocopiable worksheets in the MoneySense booklets.

“MoneySense™” means the Ulster Bank Limited programme of teaching money management and enterprise skills whose full name is "Ulster Bank MoneySense for Schools" and which includes the content of the MoneySense website and the content of the MoneySense booklets.

“RBS Group” means (a) The Royal Bank of Scotland plc; and (b) any company that is from time to time (i) a holding company, (ii) a subsidiary or (iii) a subsidiary of a holding company, of The Royal Bank of Scotland plc. For the purposes of the definition of the RBS Group the expressions “holding company” and “subsidiary” have the meanings given to them in the Companies (Northern Ireland) Order 1986 (as amended).  In this Agreement companies within the RBS Group are called “members” of the RBS Group.

“School” means a school in Northern Ireland which has registered with MoneySense via a teacher.

“Software” refers to Adobe Acrobat Reader, Flash Player and Windows Media Player which are required to view various elements on the site such as downloadable PDFs and Flash activities and videos. Flash version 8 or higher is required.

“Teacher” means the teacher or tutor named in the School's Registration Form who is authorised by the School to use MoneySense and accept communications from Ulster Bank on behalf of the School.

 “Teachers’ Notes area” means the area of the MoneySense site only accessible via registration and use of a User ID.

“Ulster Bank”/ “us”/ “our”/ “we” means Ulster Bank Limited.

“User”/ “you”/ “your” means any user of MoneySense.

"User ID" means the individual User ID given to the Teacher and which must used in order to access and/or download the content in the Teachers’ Notes area of the MoneySense website.

2. MoneySense content

2.1 Ulster Bank is committed to making its MoneySense for Schools programme available to teachers and schools in Scotland and England. The materials relating to the MoneySense for Schools programme and the participation of Ulster Bank’s employees in this programme (when a Ulster Bank employee is available to participate), are provided free of charge to those schools interested in this programme.

If you are approached by a third party for any payment relating to any aspect of the delivery of our MoneySense for Schools programme, please note that this step is being taken by these third parties without Ulster Bank's knowledge, authority or consent. If this happens, please contact us and let us know.

2.2 MoneySense is designed to assist teachers and students in the learning of money management and enterprise skills and should always be used in addition to relevant curriculum material. MoneySense is not designed to be used for advising in relation to any individual or business financial circumstances and should not be used in such a context.

2.3 Views expressed in MoneySense are not necessarily those of Ulster Bank.

2.4 Ulster Bank will use reasonable endeavours to correct any inaccuracies in MoneySense content that are brought to its attention. However, Ulster Bank does not accept any other obligations or liabilities in respect of inaccuracies in MoneySense content.

2.5 You should ensure that any information you provide to us for use on the site is copyright free.

3. Copyright Licence

3.1 You hereby grant us a non-exclusive royalty-free licence to use, copy, publish, amend and modify any material or part thereof which you provide to us for use on the MoneySense website.

4. Improper use

4.1 The User agrees that it shall use MoneySense for lawful purposes only.

4.2 The User shall not knowingly use MoneySense to receive or transmit material that is obscene, offensive, defamatory, in breach of confidence or in breach of any intellectual property rights.

5. Registrations

5.1 The MoneySense website invites Users who are teachers or tutors to register with MoneySense on behalf of the school they are employed by, in order to be able to access and download the content of the Teachers’ Notes area.

5.2 The School's computing system will require Adobe Acrobat Reader to view PDF documents, and the latest version of the Flash Player to view the Flash videos and activities which are available of the MoneySense website.

5.3 The School is responsible for the supply, maintenance and compatibility of its computer system(s) being used to access the online MoneySense programme.

6. Software

6.1 Where either the Flash Player or Adobe Acrobat reader is required to view elements on this website a link has been provided to enable users to download this software.

6.2 Ulster Bank is not responsible for the Software and accepts no liability for any losses resulting from use of the Software.

7. User ID

7.1 Upon registration, the Teacher will be allocated a User ID.

7.2 The User ID must be used in order to access and/or download content from the Teachers’ Notes area of the MoneySense website.

7.3 The Teacher must not disclose or reveal his/her User ID to any third party or keep it in a place where it might be discovered.

8. Confidentiality

8.1 Ulster Bank shall use all reasonable endeavours to ensure that School and Teacher information (held by Ulster Bank and/or members of the RBS Group) is kept confidential, is used only in accordance with this agreement, and is not disclosed to any third party unless Ulster Bank and/or members of the RBS Group are required to disclose by law or with the School's and/or Teacher's consent.

8.2 The Teacher agrees to personal information held by Ulster Bank and/or members of the RBS Group being used by Ulster Bank and/or members of the RBS Group from time to time in order to contact the Teacher and obtain feedback about MoneySense. If the Teacher does not want to be contacted by Ulster Bank and/or members of the RBS Group, he/she should write to the MoneySense for Schools, FREEPOST RR59, ROCHESTER, Kent, ME2 4BR.

9. Intellectual Property rights

9.1 The School is allowed to reproduce the Modules for the purposes of teaching at the School only.

9.2 Notwithstanding clause 9.1, the School shall not copy, republish or reproduce (by electronic means or otherwise), use, sell or lend the Modules or any extracts from the Modules without Ulster Bank's written consent.

9.3 The School acknowledges that the copyright and all other intellectual property rights in the Modules (including the form or manner in which the Modules are arranged or presented by Ulster Bank) shall continue to be the property of Ulster Bank and/or the RBS Group.

10. Variation

10.1 Ulster Bank reserves the right to change, amend, or withdraw the content (or any part of the content) of the MoneySense website and/or Modules from time to time and shall, where possible, give the School reasonable notice of any such changes.

10.2 Ulster Bank reserves the right to vary the conditions of this Agreement from time to time and will always give the School at least 30 days written notice before any such change takes effect.

11. Liability

11.1 The provisions set out in this clause 11 should be read carefully as they exclude or limit Ulster Bank’s legal liability in connection with your use of this website. Nothing in these terms and conditions and in particular within this clause 11 shall attempt to exclude liability that is not permissible under applicable law, including without limitation, for death or personal injury, or for fraudulent misrepresentation.

11.2 Nothing in these terms and conditions shall exclude or limit or restrict Ulster Bank’s duties and liabilities to you under the Financial Services and Markets Act 2000, or any conduct of business rules which Ulster Bank is bound to comply with.

11.3 While Ulster Bank has taken all reasonable steps to ensure the accuracy and completeness of the content of the website, Ulster Bank excludes any warranties, undertakings or representations (either express or implied) to the full extent permitted under applicable law, that the website or (including without limitation) all or any part of the content or materials, accuracy, availability or completeness of the content of the website or any part of the content or materials are appropriate or available for use either in Northern Ireland or in other jurisdictions. If you use this website from other jurisdictions, you are responsible for compliance with applicable local laws.

11.4 Ulster Bank accepts no liability (including without limitation) in either contract, tort, negligence, statutory duty or otherwise (to the maximum extent permitted by applicable law) arising out of the use of or access to this website (which includes without limitation) any errors or omissions contained in this website or if the website is unavailable and Ulster Bank shall not be liable for any direct or indirect:

  • economic losses (including without limitation loss of revenues, data, profits, contracts, use, opportunity, business or anticipated savings);
  • loss of goodwill or reputation;
  • special, incidental, consequential loss or damage, suffered or incurred arising out of or in connection with your use of this website and these terms and conditions.

11.5 Access to and use of this website is at the user's own risk and Ulster Bank does not warrant that the use of this website or any material downloaded from it will not cause damage to any property, or otherwise minimise or eliminate the inherent risks of the internet including but not limited to loss of data, computer virus infection, spyware, malicious software, trojans and worms. Also, Ulster Bank accepts no liability in respect of losses or damages arising out of changes made to the content of this website by unauthorised third parties.

11.6 To provide increased value to users of this website, Ulster Bank may provide links to other websites or resources (that are not part of Ulster Bank or the RBS Group) for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website Ulster Bank is are not responsible for the availability of such external sites or resources, and do not review or endorse and shall not be responsible or liable, directly or indirectly, for: (i) the privacy practices of such websites; (ii) the content of such websites, including (without limitation) any advertising, products, goods or other materials or services on or available from such websites or resources; or (iii) the use that others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

11.7 The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages.

12. Termination

12.1 The School may terminate its registration at any time by giving written notice to Ulster Bank.

12.2 Ulster Bank reserves the right to suspend the School's registration where it has not used the MoneySense Modules within a period of 90 consecutive days.

12.3 Ulster Bank may terminate the School's registration by giving at least 30 days notice. However, Ulster Bank may terminate the school's registration upon shorter notice if:

i. the Teacher is persistently in breach of this Agreement or in the event of their fraud or misuse of MoneySense.

ii. it is reasonably necessary to protect Ulster Bank and/or Teacher and/or the School.

13. Telephone Calls

13.1 Telephone calls may be recorded or monitored in order to maintain and improve our service.

14. Applicable law

14.1 The terms and conditions of this Agreement will be construed in accordance with the laws of Northern Ireland and will be subject to the exclusive jurisdiction of the Northern Irish courts.
